Real estate for foreigners
The Migration Code of Azerbaijan gives the following rights to foreigners and stateless persons: While staying in the Republic of Azerbaijan, foreigners and stateless persons can enjoy all the rights equally with the citizens of the Republic of Azerbaijan, unless otherwise provided by law or international treaties to which the Republic of Azerbaijan is a party.
The rights and freedoms of foreigners and stateless persons residing or temporarily residing on the territory of the Republic of Azerbaijan may be restricted only in accordance with international law and the laws of the Republic of Azerbaijan.
Foreigners and stateless persons are equal before the law and court in the Republic of Azerbaijan, regardless of their social and property status, race, and nationality, sex, language, religion, type, and character of their activities and other circumstances. Except as provided for by the Labor Code of the Republic of Azerbaijan, migrant workers shall be subject to the same conditions as established by the legislation for their citizens and their remuneration shall be provided for by the legislation of the Republic of Azerbaijan.
Labor Code of the Republic of Azerbaijan
Unless otherwise provided by law or international treaties to which the Republic of Azerbaijan is a party, foreigners and stateless persons while staying in the Republic of Azerbaijan shall enjoy all labor rights and bear responsibilities related to these rights. Restrictions on the labor rights of foreigners and stateless persons, as provided for by this Code and other legal acts, except for the cases stipulated by the law, are prohibited. Determination of superior rights to foreigners and stateless persons than citizens of the Republic of Azerbaijan in labor relations is inadmissible. Employers must obtain work permits for every foreigner and the stateless person they wish to hire, except as provided in Article 64 of the Migration Code of The Republic of Azerbaijan, in accordance with the rules and conditions set forth in that Code. Issues not covered by the Migration Code of the Republic of Azerbaijan concerning labor activity of migrant workers shall be regulated by this Code. Control over the protection of the rights of migrant workers by employers is exercised by the relevant executive authority.
Tax Code of the Republic of Azerbaijan
Foreigners and stateless persons wishing to carry out entrepreneurial activity without forming a legal entity shall be registered as taxpayers in tax authorities on the basis of a certificate issued by the relevant executive authority.
Election Code of the Republic of Azerbaijan
Non-stateless persons, who meet the requirements of Article 12.1 of the Electoral Code and have been permanently residing in the Republic of Azerbaijan for at least 5 years, may participate in voting in the presidential elections, elections to the Parliament, municipal elections or referenda. Citizens of a foreign country who meet the requirements specified in Article 12.1 of the Election Code and have been living in the municipality for at least 5 years can participate in the municipal elections (provided that aliens have the same rights in the elections in the countries where they are citizens). In view of the exceptions provided in Article 12.2 of the Election Code, stateless persons are not active and passive in the Republic of Azerbaijan. Foreigners do not have active and passive suffrage in the Republic of Azerbaijan, with the exception provided for in Article 12.3 of the Election Code. Foreigners, stateless persons, foreign legal entities, their branches and representative offices (hereinafter – foreign legal entities) may not participate in the nomination, registration of candidates or election campaigns of registered candidates.
